One Year Check-In: Pregnant Workers Fairness Act
The Pregnant Workers Fairness Act (“PWFA”) went into effect on June 27, 2023, and requires covered entities to provide reasonable accommodations to employees or applicants with known limitation related to pregnancy, childbirth, or related medical conditions, absent undue hardship. The U.S. Equal Employment Opportunity Commission’s regulations about how it will interpret and enforce the PWFA went into effect June 18, 2024.
Employers’ understanding of their obligations under the PWFA and newly implemented regulations has greatly expanded over the last year. Employers’ obligations and rights are notably different than the Americans with Disabilities Act, including requiring employers to temporarily suspend essential functions and limiting the information that an employer can require from an employee requesting an accommodation.
