Disability Discrimination & the Mental Health Crisis

One of the most common calls we receive on the NIRMA Employment Hotline is about how to lawfully navigate employees’ medical situations, including how to manage an employee’s medical leave of absence, engage in the interactive process when an employee may need a reasonable accommodation, and address when an employee’s disability may pose a significant risk of harm to themselves or others.

In our April Roundtable, we will specifically focus on how to manage mental health concerns in the workplace.   Addressing these issues can be a delicate balance.  On the one hand, employers empathize with mental health struggles.  While on the other hand, employers are uncertain how to manage work performance or conduct concerns that are related to an employee’s mental health challenges. We will address best practices on how to engage in the interactive process without appearing to “regard” someone as being disabled.
